Rent increase guidelines for tenants & landlords

There’s a lot of information for landlords on how to deal with problematic tenants in case of late payments or bad maintenance, but tenants are often unaware of their rights. As a result, they never seek help from the regulatory bodies in case they have been harassed by the landlord, or if the property owner has come up with a sudden, unfair increase in rent. Many tenants believe, just because the landlord is the owner of the property, it is his/her right to raise the rent at any given time. The truth is that they need to notify you in advance; if you think that the raise is way too much, you can even challenge it with the legal authorities (though it may not be a valid option in some parts of this world).

Rent Increase Notice:

In most cases, Landlord has to inform the tenants by issuing a notice beforehand, normally more than 2 months in advance. If not, tenants are in no way obligated to pay the increased amount. The amount of new rent and the date when it will be applicable should be mentioned. Remember, you can’t go around increasing rent every other month; the normal time frame for a rent increase is at least after a space of 12 years in most states. Many states require landlords to specify a valid reason for the rent increase. If you have got the notion that the landlord is treating you with some sort of discrimination because of your religion, race or gender, you reserve the rights to complain to your local authorities. You are also entitled for some rent relaxations, if you are a senior citizen.

Rent increase predicament for landlords:
Many property owners find themselves in a fix when it comes to increasing rent (unless these owners are old hands at buying and renting properties). Biggest constraints could be the possibility of tenant checking out or the scenario where you have developed friendly relations with tenants through the course of time. Though valid, but these reasons do not justify the financial losses that you may bring upon yourself. Ideal way is to proceed with small increase instead of demanding a big lift out of the blue. For deciding the rate of increase, you may consult the guidelines issued by your local authorities. Many landlords will also keep the tenants behavior in mind when deciding upon the increase, if the tenants have been good so far, they will keep the raise to bare minimum, if not, they will ask for a bigger raise.

Changes In Rental Law In Dubai And How It Affects The People

For the numerous people who come to Dubai, the new rental laws and their implications are very important. With the great influx of people in Dubai, rental laws have become a very important issue. With the rising demands for rented property in Dubai, the rents have increased considerably over the years. All the people who come to Dubai for work face the problem of exorbitant rents. But the new law will come as a breath of fresh air because it states that the rent cannot be increased by more than 5% of the lease price.

Rental allowance is reserved for the expatriates. Earlier, the individuals would be paid the entire rent by the employer but recently, the companies give their employees a certain percentage of the yearly housing costs and the rest has to be coughed up by the person concerned. When it comes to renting property in Dubai, there are other costs that come to the forefront like a security deposit, car parking money, municipality fees, other monthly utilities and in case you have sought the help of a real estate agent to get hold of the property, you have to set aside 5% commission for the agent as well. You need to remember that you will not be able to make any changes in the rented property.

For the expatriates, their company signs the lease with the landlord of the concerned property. The expatriate can only sign if he is a holder of the residence visa. Generally, the lease is valid for a period of one year and it is, however, extendable if there is no breach of contract from the side of the tenant or if the landlord requires the property for personal reasons. The rent of the entire year is paid at a time. The new revised rental laws in Dubai are actually quite favorable for the tenants. In case of any disputes, the Dubai Rental Committee is a body that is there to resolve any issues that emerge between the landlord and the tenant.

Sources in the government have been quoted as saying that the rental laws in Dubai will soon be undergoing another major change. These laws will look at solving the landlord – tenant dispute and also play an important role in the way things are done when it comes to renting property.

At present, any dispute related to rental property is sorted out by the Rents Committee. However, with the new law that will come into force, the whole scenario is about to change. The law has been passed by the Vice President, Prime Minister of UAE and Ruler of Dubai, H.H Shaikh Mohammad bin Rashid Al Maktoum.

All issues related to renting property in Dubai, like tenancy, subletting, bachelor accommodation etc' will be solved by the Dubai Land Department. The new law will change many things significantly. One, however, cannot be sure if the rent cap too will be subjected to change. The ever increasing rents have long been the problem for numerous expatriates who come into Dubai for work.

This law will look at everything related to rented property with a new perspective. It will play a major role in developing the already strong property market in Dubai.

Before Screening Tenants You Must Know These Important Steps

Screening tenants is one of the most important aspects of being a landlord. Some landlords make the fatal mistake of renting out to the first person who comes along, just to fill up the vacancies and get those rental payments coming in.

Doing a thorough rental screening is vitally important to avoid problems down the road. The vast majority of problems like late or defaulted rental payments, disruptive tenants, and property damage can be avoided with careful tenant screening.

Your First Contact with a Potential Tenant

Usually a landlord's first contact with a prospective tenant is by telephone. This is a good time to get a sense of how likely the tenant is a good match for you. You should have some questions ready to pre-screen the person so that you'll know whether you want to move on to the next step.

When screening tenants, some important things to ask include basic biographical information such as name, address and phone number. You'll also want to ask some preliminary questions about the amount and sources of the person's income. Find out if he has any pets, smoking habits, and the age and number of people who will live with him.

If the person is willing to provide a credit report, take a look at it before you move on to a face to face meeting in the next step. Otherwise you will need to request a copy later in the screening process. You should also check to see if the tenant has good references from his previous landlords.

Most prospective renters will be more than happy to answer your questions. Be cautious if the person seems wary or reluctant to provide the information you're asking for.

After you've determined that the person is a good candidate to rent your property, it's time to meet him in person. There are a few of important principles to remember - read between the lines, take stock of the person's appearance, and don't let your emotions cloud your judgment.

When you're talking to the prospective tenant, really listen to what they have to say. If the tenant says, "My dog Charlie chewed up my new sofa," or "I just met with my child's teacher and he's in trouble for fighting again!", then you may have trouble brewing on your hands.

When it comes to screening tenants, their physical appearance is an important factor to consider. The person does not have to dress like a movie star but what you are looking for is someone who is clean and presentable.

You can also check out his car. Does it seem to be in reasonably good condition? Is the car overloaded with junk inside? Again it doesn't matter how new or expensive the car is; you are looking to see if the person actually takes good care of it.

Why do these factors matter? Someone with a tidy appearance and well kept vehicle is far more likely to take better care of your rental property as well.

Don't Involve Your Emotions When Screening Tenants

When you are screening your potential renters, your emotions and personal feelings should not affect your decision of picking the right tenant. Even if you find the person incredibly charming and sweet, do realize that the nicest people in the world don't always make best tenants.

A wonderfully charming and lovely person could have the most horrible credit history in the world, or a history of defaulting on rent payments. Make it a purely business decision.

Finally, don't let a sob story get to you. As much as you may want to help that single mom who is going through a divorce, if her credit and rental history indicates that she can't pay, don't risk your own financial security. After all, you are not a charity organization; you're a landlord.

10 Tips For Finding A Great Apartment

Finding a new apartment can be a exciting endeavor, but at the same time a frustrating process. Here are a few tips to ensure that your apartment search is fast, efficient and fun!

1. Do your research: It took me about 6 months to find my perfect apartment, but when I did, I had a great understanding of the rental rates in each of the areas I was searching. When time came to sign the lease, I knew that the apartment I had chosen was below the average rental rates in the area and that I was getting a bargain.

2. Start your search early: Starting your apartment search a few months prior to your move in date is a good way to ensure that you're not leaving it to the last minute. There's no worse feeling than the pressure of knowing you only have a couple days to find an apartment and that most of the best apartments have already been rented. A good rule of thumb is start to the process at 90-120 days prior to your move in date.

3. Choose your amenities: Make a long list of amenities (10) that you absolutely must have. Then be prepared to cut that list in half. Finding an apartment that meets all of the items in your wish list is probably not going happen, so be prepared to cut the amenities that are least important to you. A pool sounds like a great idea, but if you can live without it your options will increase.

4. Don't wait, act fast: Once you've found the apartment of your dreams, be prepared to sign on the dotted line because chances are there will be numerous other people behind you ready to do the same. Great apartments can be hard to find so don't let them get away, call the landlord directly and try to avoid emailing the rental office. More often than not, the email response times are like molasses on a cold day.

5. Do your neighborhood research: If you are moving into a new neighborhood then make sure you know what you're getting into beforehand. There are a few useful Apartments For Rent resources that will actually give you average rental rates, driving distances to nearby cities, employment information, things to do and attractions to see. It's much easier to do the research online than to visit each hood in person.

For me, apartment living is a temporary lifestyle. My long term goal is to eventually move from renting to owning. Every extra dollar that I spend on rent, results in less money that I will save for my future home. My rule is that if it's something that isn't absolutely necessary, then don't spend the extra money. It's much better off in your pocket than someone else's. A good rule of thumb is planning to pay around 25% of your income to rent.

7. Safety first: If you're moving to a new city or even a new neighborhood in your existing city, be sure that the area is safe and the demographics are a match. Check out the crime rates and demographic information that will inform you as to the average age, income bracket, gender and even marital status. If you're a young couple looking for a bit of excitement, the last thing you want is to move into an area where the average age is 54! The crime rates are also available and will give you detailed analysis on everything you need to know. Do your research first, so there are no surprises.

8. Prepare your documents: Most landlords are looking for well organized, responsible tenants. Being prepared when you tour the apartment is a step in the right direction and creates a good first impression. Bring your credit report, bank statements, proof of employment and references. Having all these documents at your disposal will go a long way in securing your new apartment rental.

9. Special offers: Although many respectable buildings do offer special offers like rent discounts, upgrades or even free gifts, watch out for the buildings that offer these extras because they have real trouble filling their buildings. If the offer is too good to be true, do your due diligence to ensure that the building is up to your standards. Many buildings offer free gifts simply because they cannot find anyone to rent in that building.

10. Speak to a current resident: This may be the best piece of advice. Current residents will offer the best possible feedback about the quality of the building and amenities in the area. Knock on a few doors and ask residents what they think of the building, the landlord and the area in general. It will also give you a good idea who your potential new neighbors will be.

That's about it. These are the tips that I followed on my search and I'm now living happily in a great apartment at a fantastic monthly rate.
